Terms and Conditions of Service

All Indabox S.r.l. | Parkito

These Terms of Service (the “Terms”) constitute a legally binding agreement between you and All Indabox S.r.l. They govern your right to use the websites, applications and other offerings of Parkito (collectively, the “Parkito Platform”). In these Terms, “Parkito”, “we”, “us” or “our” refer to All Indabox S.r.l., whose details are set out in Article 27.

The Parkito Platform is an online venue that allows users to publish, offer, search for and book services. Registered users are “Members”. Members who publish and offer Parking Spaces are “Hosts”. Anyone who searches for, books or uses the services is a “Driver”, including when booking without registering (a “Guest Driver”, Art. 1.5). Hosts offer car spaces and parking areas (the “Parking Spaces”), and each offer of a Parking Space constitutes a “Listing”.

For Parking Spaces, Parkito provides the Platform and does not own, control, offer or manage any Listing. The parking agreement (the “Booking”) is concluded directly between the Driver and the Host. Parkito is not a party to that agreement, save as provided in Articles 2.3 and 6. Parkito is not an estate agent, a travel agency, an insurer, or an organiser or retailer of package travel within the meaning of Directive (EU) 2015/2302.

Parkito also offers, directly or through third parties identified from time to time, the following services (the “Parkito Services”): the shuttle service (Art. 10), the service for access to Area C of the Municipality of Milan (Art. 11) and the sale of access-control devices to Hosts (Art. 9).

The processing of personal data is governed by Parkito’s Privacy Policy, available at the following link: https://parkito.app/privacy-policy (the “Privacy Policy”). We invite you to read it before using the Parkito Platform.

Terms for Drivers

1. Search, booking and price

You can search for Parking Spaces by entering the destination, the date and time of arrival and departure, and the type of vehicle. The results show only Parking Spaces that are compatible with your vehicle and available for the requested period. The criteria for ranking results are described in Art. 5.5.

1.2 Booking

Before payment, the Parkito Platform shows you the Booking summary: the Parking Space, the entry and exit times, the access arrangements and the overall price, inclusive of every item (the “Total Price”). By confirming and paying, you conclude the Booking with the Host, on the terms stated in the Listing and in these Terms. The specific rules of each Booking, including the access instructions, are visible in the Listing and in the “Booking Details” section of the application. It is your responsibility to read them before booking.

Hosts may be private individuals or professionals, and Parkito indicates their status on the website and in the application. If the Host is a private individual, the protections provided by the Italian Consumer Code (Codice del Consumo) for relations between consumers and professionals do not apply to the Booking. The protections that these Terms grant you as against Parkito remain unaffected.

1.2.1 Custody

The Parking Space you book will always be unattended unless custody of vehicles is expressly mentioned in the Booking summary. Hosts who independently decide to offer a custody service are fully liable for any failure to perform this activity properly. As this is a free and independent initiative of the Hosts, Parkito cannot in any way be held liable for any damage or liability connected with this service.

1.3 How the price is calculated

1.3.1 Hourly-rate Parking Spaces. The price is calculated on the basis of the hourly rate set by the Host, which may vary according to the date and time. For longer stays, progressive reductions and a maximum daily amount are applied automatically. The reductions are designed so that a longer stay never costs less than a shorter one, the average price per hour does not increase with duration, and each additional day costs less than the previous one. The reductions are calculated on the hours of parking, counted from the Booking start time in periods of 24 hours, and not on calendar days: for the same duration, the price does not depend on the start time. If the Host has also indicated daily, weekly or monthly rates, the Parkito Platform applies the combination that is most advantageous for the Driver.

1.3.2 Daily Parking Spaces. Some Listings are offered only by the day, week or month. In that case, the stay is calculated in whole periods of 24 hours, 7 days or 1 month starting from the entry time, and each period begun is counted in full. The exit time is adjusted accordingly. For the entire period paid for, you have exclusive use of the Parking Space and may enter and exit at any time, including at night and multiple times, in accordance with the access instructions (Art. 5.2.1). If the Host has indicated only a daily, weekly or monthly rate, the minimum amount charged corresponds to that period even for a shorter stay. The summary before payment states the exit time and any minimum charge.

1.3.3 Service fees. The Parkito service fees, inclusive of VAT, are added to the price set by the Host and are shown separately in the summary. The service fees comprise:

  • a platform commission proportional to the price of the stay, subject to a minimum amount;
  • a surcharge of € 1.20, applied to the first Booking, that is, when the account has no confirmed Booking, and to every Booking made as a Guest Driver;
  • rounding of the total up to the next € 0.50.

1.3.4 Access charges for limited traffic zones. If the Parking Space is located in a limited traffic zone (“ZTL”) that is active at the entry time and requires an access charge, the amount is shown separately at the time of booking. You may exclude it by declaring that you have already paid it or will pay it yourself. See also Art. 3.2.

1.3.5 Total Price. The Total Price shown before payment is the only amount due for the Booking. This is without prejudice to amounts that subsequently fall due under Articles 1.4, 2.6, 2.7 and 20, subject to prior notice.

1.4 Use of the Parking Space and overstaying

The Booking gives you the right to access and occupy the Parking Space for the booked period. The Host may access the Parking Space during that period only where reasonably necessary, provided for in the Listing and in compliance with the law. If you stay beyond the exit time, the Host may ask you to vacate the Parking Space. For the excess stay, the following may be charged:

  • the hourly price stated in the Listing for each additional hour or part thereof;
  • the amount refunded to other Drivers who were unable to use the Parking Space because of your stay.

The charge is made by Parkito to the stored payment method (Art. 13), with notice of the amount and of how it was calculated. If you are a consumer within the meaning of Art. 3(1)(a) of Legislative Decree 206/2005 (Consumer Code), the total amount may not exceed twice the Total Price of the Booking. You may dispute the charge within 14 (fourteen) days of the notice; if disputed, the charge is suspended pending the outcome of the review.

1.5 Bookings without an account (Guest Driver)

On the website you can book without registering, by providing an e-mail address and the required details. By paying, you accept these Terms in the version in force at that time, including the clauses listed at the end. Upon confirmation you receive a Booking code.

To manage the Booking, including requesting changes (Art. 2.6), you must link it to a Parkito account by entering the code in the application. Cancellation (Art. 2.1) may also be made using the dedicated button in the confirmation e-mail. Until the Booking is linked to an account, it cannot be changed. The rights that the law grants to consumers and that cannot be excluded by contract remain unaffected, as does the right to a refund under Art. 2.2, which you may exercise by contacting the Support Service with the Booking code.
You may access the Parking Space only after verifying your identity through the application, and you must be of legal age. Otherwise you will not be entitled to any refund.

Discount codes (Art. 24) do not apply to Guest Driver Bookings. No ZTL access charge is made: the Guest Driver pays it independently.

2. Cancellations, refunds and changes to Bookings

2.1 Cancellation by the Driver

You may cancel a Booking from the application up to the start time. The refund depends on the number of calendar days, according to Italian time, between the day of cancellation and the day the Booking starts:

  • 7 (seven) days or more: full refund (100%);
  • from 4 (four) to 6 (six) days: 50% refund;
  • 2 (two) or 3 (three) days: 20% refund;
  • the day before or the same day: no refund.

Example: for a Booking starting on Saturday at 9:00, a cancellation made on Thursday gives entitlement to 20%; one made on Friday gives no entitlement to any refund.

The percentage applies to everything paid for the Booking, including service fees, any ZTL charges where already paid to the relevant Municipality, and extensions. After the start time the Booking cannot be cancelled, save as provided in Art. 2.2.

2.2 Inability to access the Parking Space

You are entitled to a full refund (100%) if you cannot access the Parking Space for reasons attributable to the Host or to the Platform, and the Support Service neither resolves the problem nor finds an available alternative Parking Space within 1 km. This applies in particular in the following cases:

  • Parking Spaces with in-person access: the Host does not show up and does not respond to in-app messages or calls;
  • Parking Spaces with automated access: the application does not provide the authorisations needed to open the gates, or the device does not work.

To obtain the refund you must report the problem to the Support Service via the application or via the freephone number +39 800 816 980, within 2 (two) hours of the start of the Booking. Reports of failed access submitted after that deadline cannot be accepted, unless you prove that you were unable to contact the Support Service for reasons not attributable to you.

Daily Parking Spaces. In Bookings of Daily Parking Spaces (Art. 1.3.2), the Host must guarantee you access, both in and out, for the entire booked period (Art. 5.2.1). The following rules apply in addition to those in the first paragraph. If at any time during the period you cannot enter or exit for reasons attributable to the Host or to the Platform, report it immediately to the Support Service, and in any event before the end of the Booking; in this case the 2 (two) hour deadline does not apply. If the Support Service does not resolve the problem, you are entitled, at your choice, to an available alternative Parking Space within 1 km or to a refund as follows:

  • in the first 24-hour period: full (100%);
  • in a subsequent period: of the portion of the Total Price relating to the 24-hour period in which the problem occurs and to all subsequent periods, in proportion to the number of periods booked.

Example: for a 5-day Booking, if on the third day you cannot exit the Parking Space and the problem is not resolved, you are refunded 3/5 of the Total Price.

Refunds are excluded for external impediments beyond the control of Parkito and the Host, for example a road closed for public works.

2.3 Cancellation by the Host and possible relocation

If the Host cancels a confirmed Booking, Parkito looks for an alternative Parking Space and, if it finds one, offers you the change. As a rule, the change is within 1 (one) kilometre of the original Parking Space, for the same period and at an equal or lower price. If you approve the change, the new Booking replaces the cancelled one, any price difference is refunded to you, and you receive notice of the new Booking via the application and by e-mail. If you do not accept the change or no alternative Parking Space is available, everything you paid is refunded in full. If you do not respond to the Support Service by the start time of the original Booking, you are refunded what you paid net of the platform commission (Art. 1.3.3).

2.4 Cancellation by Parkito

Parkito may cancel a Booking for justified reasons, including safety, fraud prevention, breach of these Terms or unavailability of the Parking Space. In that case, if the cancellation is not due to a breach on your part, everything you paid is refunded in full. Otherwise, Parkito will ensure that the Host is duly paid.

2.5 Support Service

Parkito’s support service (the “Support Service”) can be reached via the application and at the contact details given in the “Support” section. The Support Service may be provided in part by an automated assistant (Art. 17). To ensure adequate response times, Parkito may limit the number of new non-urgent requests opened by the same user in relation to the same booking. Reports of failed access to the Parking Space are not subject to that limit.

Refund requests for reasons other than those in Art. 2.2 remain subject solely to the conditions of Art. 2.1. They must be submitted within 24 (twenty-four) hours of the end time of the Booking.

2.6 Changes and extensions

You may request to bring forward the entry time, if the Booking has not yet started, or to postpone the exit time, within the duration and availability limits shown in the application. The additional amount is calculated on the hourly rate of the Listing for the added period only. It may therefore not correspond to the rate that would have applied had the entire period been booked originally. The additional amount is shown to you before confirmation and is charged separately.

It is not possible to shorten the duration of a confirmed Booking; to give it up, Art. 2.1 applies. Bookings of Daily Parking Spaces (Art. 1.3.2) cannot be extended: a further period requires a new Booking.

The Support Service may, at your request, extend a Booking on your behalf and charge the amount, up to a value not exceeding that calculated under this article, to the stored payment method (Art. 13).

2.7 “Repeated” Bookings

Bookings are “repeated” where they are made by the same Driver, for the same Parking Space, with the same vehicle and on the same day, no more than 8 (eight) hours apart from one another. In that case Parkito may charge for the intervening unbooked hours, calculated on the hourly rate of the Listing.

Before any charge, Parkito informs you, via the application or by e-mail, of the amount and the method of calculation. If you are a consumer, the charge is made only with your express consent, given by in-app confirmation or written reply within 7 (seven) days of the notice; failing that, the charge is not made. If you are not a consumer, the charge is deemed accepted if not disputed within the same period.

3. Your responsibilities and limited traffic zones

3.1 Responsibility

You are responsible for your acts and omissions, and for those of anyone who accesses the Parking Space with you or whom you allow to access it. This responsibility covers the Parking Space and the common areas that the Host and the Driver are entitled to use (the “Common Areas”).

3.2 Limited traffic zones

The information provided by the Parkito Platform on ZTLs, traffic-restricted areas and low-emission zones, including time bands and any activation status, is indicative. It is collected from public sources and may not be up to date or complete. Parkito does not communicate vehicle data to Municipalities or other authorities and does not issue access permits, except for the service referred to in Art. 11. You are required to check with official sources whether your vehicle may enter and to obtain the necessary permits. Penalties arising from unauthorised access remain your responsibility, unless they result from incorrect information provided by Parkito through its fault.

Terms for Hosts

4. Renting out on Parkito

4.1 The Host

As a Host you may use the Parkito Platform, in accordance with these Terms, to make your Parking Space available in return for a fee. You set the price, availability and rules of each Listing.

4.2 Agreement with Drivers

By confirming a Booking you conclude an agreement directly with the Driver and you are responsible for making the Parking Space available in accordance with the terms and price of your Listing. You accept these Terms, including the clauses indicated at the end, upon completing the registration procedure as a Host.

4.3 Host status

If you make Parking Spaces available in the course of a business or professional activity, you must inform Parkito of this through the Support Service and provide your company name and VAT number. You remain responsible for the obligations that the law imposes on you in that capacity, including those towards consumer Drivers.

4.4 Host independence

Your relationship with Parkito is that of an independent party and not of an employee, agent, partner or joint venture participant. Parkito does not direct or control the activity by which you make the Parking Space available. By accepting these Terms you authorise Parkito to receive Drivers’ payments on your behalf, through Stripe (Art. 6.1): payment made by the Driver through the Platform discharges the Driver’s debt to you (Art. 1188 of the Italian Civil Code). The collection and payout arrangements are described in Art. 6.

5. Managing the Listing

5.1 Creating and managing the Listing

Your Listing must contain complete, accurate and up-to-date information, including availability, photographs and access instructions. Only one Listing is permitted for each Parking Space; you may publish several Listings for a property comprising several Parking Spaces.

To enable self-service access you may use devices integrated with the Platform, which you may purchase from retailers of your choice or from Parkito (Art. 9).

5.2 Prices and rental methods

You may offer the Parking Space at an hourly rate, with optional additional daily, weekly or monthly rates, or by the day only. The amount due to you for each Booking is the price resulting from your rates, calculated in accordance with Art. 1.3 and with the reductions under Art. 5.2.2. The Driver pays that amount plus the Parkito service fees, which the Platform shows before confirmation.

You may change your rates at any time; changes do not affect Bookings already confirmed. You may not change the rental method (hourly or daily) while the Parking Space has confirmed Bookings that have not yet ended.

5.2.1 Daily rental: your obligations

If you offer the Parking Space by the day, each Booking gives the Driver access for whole periods of 24 hours (Art. 1.3.2). For the entire duration of the Booking you undertake to:

  • guarantee access at any time: the Driver must be able to enter and exit at any hour of the day or night, including on public holidays and multiple times, without time-band restrictions;
  • choose how to guarantee it: by means of an access device integrated with the Platform, which is the recommended method, or by opening in person. If an access point to the Parking Space has no device, you undertake to be reachable through the Platform and to open in person without unjustified delay, including at night;
  • leave the Parking Space to the Driver: the Parking Space is reserved for the Driver for the entire period. You may not occupy it, rent it to others, including outside the Platform, or obstruct its use, save for the strictly necessary access provided for in Art. 1.4;
  • keep access working: if a device fails or an impediment obstructs access, you must inform the Driver and the Support Service immediately and take action without delay. Scheduled work on the Parking Space or on the device must not interrupt access during a Booking.

If the Driver cannot enter or exit for reasons attributable to you, the Driver is refunded in accordance with Art. 2.2 and the amount refunded is charged to you in accordance with Art. 6.3. In the event of repeated failures, Parkito may deactivate the daily mode of the Listing or suspend it, in accordance with Art. 18.3. Bookings already confirmed remain valid and you must honour them.

5.2.2 Price reductions

The price of a Booking is not always the hourly rate multiplied by the number of hours, the daily rate multiplied by the number of days, the weekly rate multiplied by the number of weeks or the monthly rate multiplied by the number of months. For specific Parking Spaces, the Platform may apply:

  • progressive reductions of the hourly rate beyond a certain length of stay;
  • a maximum amount for each 24-hour period, counted from the Booking start time and not per calendar day.

In any event the Platform will apply the combination most advantageous for the Driver among the hourly, daily, weekly or monthly rates you have indicated (Art. 1.3.1).

Such reductions do not apply to extensions (Art. 2.6) and reduce the amount due to you, not the Parkito service fees. The reductions follow the principles set out in Art. 1.3.1: they depend only on the length of stay and not on the start time; a longer stay is never worth less than a shorter one, the average price per hour does not increase with duration, and each additional day is worth less than the previous one. In the pricing section of the Listing, the Platform shows you in advance, for stays of different lengths, how much the Driver pays and how much you receive; you may ask the Support Service for details of the criteria at any time.

By publishing the Listing or changing its rates, you declare that you are aware of and accept these criteria. You may not claim from the Driver or from Parkito the difference between the reduced price and the hourly rate multiplied by the hours of parking. Parkito may change the criteria in accordance with Art. 19; changes do not affect Bookings already confirmed.

5.3 Publication requirements

A Listing can be booked only if it contains at least one photograph of the Parking Space and complete access instructions, including any required video. If any of these requirements ceases to be met, the Listing is automatically suspended from search results until it is restored. The suspension and its cause are shown on the Platform. Bookings already confirmed remain valid and you must honour them.

You are responsible for complying with the laws, regulations and contracts with third parties applicable to your Parking Space, for example condominium regulations, the lease agreement, prohibitions on subletting and tax rules. The information Parkito provides on legal requirements is for general information purposes only: verify your obligations independently and, if in doubt, seek professional advice.

Parkito and the Host each process Drivers’ personal data for their own purposes, as independent controllers. Parkito is the controller for the operations described in the Privacy Policy, which also informs Drivers of the processing necessary to perform the Booking. You may use Drivers’ data received through the Platform only to perform the Booking.

5.5 Ranking in search results

Search results show Parking Spaces that are compatible with the vehicle and available for the requested period, ranked by distance from the destination indicated by the Driver. The price, photographs and other content of the Listing do not affect the order of results, without prejudice to any filters applied by the Driver. Parkito does not accept payment to improve ranking. If it introduces paid ranking in the future, the relevant results will be clearly marked.

5.6 Promotion of the Listing

To promote your Parking Space, Parkito may publish it on third-party services under a name such as “Parking Space in the Parkito network” followed by the city and address, and with the contact details of the Parkito Support Service.

You may object at any time to publication on third-party services, from the Listing settings or by contacting the Support Service. In that case Parkito will remove listings already published within 30 days, to the extent permitted by the third-party service. The data processed for this purpose are described in the Privacy Policy.

5.7 Your responsibilities

You are responsible for your acts and omissions and for those of anyone you involve in managing the Parking Space. In the Listing you must state all costs and rules, and you may not collect amounts from the Driver outside the Parkito Platform, or propose that the Driver do so (Art. 14.3).

5.8 Renting out as an organisation

If you act on behalf of a company or other organisation, you declare that you have the power to bind it and you are liable for the acts and omissions of the staff you involve, whom you must inform of these Terms.

6. Host fees, payments and cancellations

6.1 Collection and payout of fees

Drivers’ payments are processed through Stripe Connect, a service of the payment service provider Stripe Payments Europe, Ltd. (“Stripe”). The amounts due to you for completed Bookings are held by Stripe until payout and are paid out to you net of payment processing costs and of any sums owed to Parkito (Art. 6.3). The processing costs are set out in Stripe’s Pricing. Payouts are made monthly, to the bank account you have indicated, for Bookings that ended in the previous month. For Bookings cancelled by the Driver with a partial refund, you are entitled to the non-refunded portion net of the Parkito service fees. The amounts and details of each payout can be viewed on the Platform.

To receive payouts you must complete identity verification and provide the information required to open your Stripe connected account. By accepting these Terms you also accept the Stripe Connected Account Agreement, which includes the Stripe Services Agreement, and you authorise Parkito to transmit to Stripe the data necessary to open and manage your payment account.

Parkito issues you an invoice for its service fees.

6.2 Cancellations by the Host

You should not cancel a confirmed Booking. If you cancel it, you are charged a cancellation fee equal to the Parkito service fees for that Booking (this represents Parkito’s loss of earnings). Repeated cancellations may result in the measures under Art. 18.

6.3 Set-off and sums owed

The sums you owe Parkito may be set off against subsequent payouts. Such sums include cancellation fees, amounts refunded to Drivers for reasons attributable to you and instalments for devices purchased in instalments (Art. 9). Alternatively, you may settle them directly through the Platform. If a refund to the Driver occurs after the payout, or exceeds your fee, Parkito may recover the amount in the same way.

As long as there are sums owed, unpaid instalments, payouts in progress or confirmed future Bookings on your Parking Spaces, closure of your Host account is suspended until they are settled. The rights granted to you by personal data protection legislation remain unaffected.

6.4 Changes to Bookings

You are liable for changes to Bookings that you accept through the Platform or that you ask the Support Service to make on your behalf.

7. Taxes and tax reporting

7.1 Taxes

You are responsible for determining and fulfilling your tax obligations relating to the fees received, including any VAT, income taxes and other taxes (the “Taxes”).

7.2 Reporting to the Agenzia delle Entrate (DAC7)

Under Legislative Decree 32/2023, transposing Council Directive (EU) 2021/514, Parkito is required to collect and verify certain Host data and to report it annually to the Agenzia delle Entrate (the Italian Revenue Agency), which may transmit it to the tax administrations of other Member States. Such data include name or company name, tax code or VAT number, date of birth, address of residence or registered office, IBAN, address of the Parking Spaces and, where available, cadastral data, as well as the fees received and the number of Bookings. Parkito asks you for such data when required by law, and you must provide them within 60 days or in any event within the time limits set by the legislation in force. If these time limits are not met, Parkito may suspend payouts and the publication of your Listings until the data are transmitted, as provided by law.

8. Insurance

It is up to you to assess and take out adequate insurance for your Parking Space. Under a cooperation agreement between Parkito and Allianz S.p.A., you may take out, for a fee, an Allianz policy dedicated to Parking Spaces offered on the Platform, distributed by an insurance intermediary registered in the Single Register of Intermediaries (RUI), identified before subscription. The policy is governed exclusively by the insurance conditions and the information set provided before subscription. A Parking Space is shown as “insured” only after the policy has been concluded and for as long as it remains in force.

The policy covers vehicles parked within the insured Parking Space, both those of Drivers and those of the Host, for the risks and within the limits, with the deductibles, exclusions and maximum amounts set out in the insurance conditions, available on request from the Support Service. In the event of a claim, notification and settlement take place in accordance with the procedures set out in the policy, and the indemnity is payable by Allianz S.p.A., not by Parkito. Insurance cover does not in itself entail custody of the vehicle, which is provided only in the cases under Art. 1.2.1. If the Parking Space is not shown as “insured”, Parkito does not insure vehicles and provides no guarantee against theft, fire, weather events or other damage to the vehicle. For damage between Members, Art. 20 applies.

9. Purchase of devices

9.1 Subject matter and price

Through the Platform you may purchase from Parkito access-control devices and related materials (the “Devices”). Before ordering, you are shown the main characteristics, the price inclusive of VAT, any shipping and installation costs and the delivery times.

9.2 Delivery

Devices are shipped to the address you indicate, as a rule within the times stated in the product sheet. You may cancel an order until it has been shipped, with a full refund of what you paid.

9.3 Right of withdrawal and warranty

If you are a consumer, you may withdraw from the purchase within 14 (fourteen) days of delivery, without giving any reason, by notifying the Support Service. The Devices must be returned within the following 14 days, with the return costs borne by you. The refund is made within 14 days of receipt of the Device. Depending on the condition in which the Devices are returned, the refund amount may be reduced. Such assessments will not be arbitrary but will be made in full compliance with the limits of the Consumer Code. In the dashboard dedicated to Hosts you will find the withdrawal form, to be completed and sent with one click directly from the dashboard itself.

The 24-month legal guarantee of conformity provided for in Arts. 128 et seq. of the Consumer Code applies; for non-consumer purchasers, the warranty provided for by the Italian Civil Code applies.

9.4 Instalment payment

At Parkito’s sole discretion, payment in instalments may be available for certain Devices, according to the plan indicated before ordering. The instalments are withheld from the monthly payouts (Art. 6.3). Before ordering, the plan states the amount, number and due dates of the instalments and any costs. If an amount remains unpaid when the plan expires, Parkito charges it to the stored payment method (Art. 13), with notice.

9.5 Installation

The Devices supplied by Parkito are, as a rule, self-installing. This means that anyone is able to complete the installation independently. Where requested, installation may be carried out by Parkito through appointed third parties, at the price and on the conditions stated in the accepted quotation. For installation on condominium gates, each Host must guarantee that they are the owner or authorised possessor of them.

Parkito Services

10. Shuttle service

10.1 The service

For certain events, such as concerts, matches or trade fairs, Parkito offers parking combined with shuttle transport between the car park and the event venue (the “Shuttle Service”). Parkito organises and sells the Shuttle Service and is your counterparty for its purchase. Transport is performed, on Parkito’s instructions and at its expense, by a licensed third-party carrier, whose details are available on request from the Support Service. Parkito is liable to you for the proper performance of the service purchased, without prejudice to the carrier’s statutory liability for the transport. If the event is postponed, the Shuttle Service is moved to the new date, at no additional cost to users.

10.2 Price

The price is shown on the event page, per person or per vehicle, and includes parking and shuttle transport. The wording “shuttle included” means that transport involves no costs in addition to the price shown. Places are limited. If, at the time of confirmation, the event is fully booked, your payment is refunded in full.

10.3 Conditions

You must arrive at the times indicated. Parkito may record boarding and entry to the car park to verify use of the service. The return journey is not guaranteed for those who do not arrive by the indicated departure time.

10.4 Cancellations and refunds

You may request cancellation from the Support Service. The scale in Art. 2.1 applies, calculated on the calendar days between the request and the date of the event. If the event is cancelled, or the service is not provided for reasons attributable to Parkito or to the carrier, everything you paid is refunded in full. Parkito may cancel the booking for justified reasons with a full refund.

11. Service for access to Area C of the Municipality of Milan

11.1 The service

At your request, Parkito, acting as your agent, purchases and activates in your name and on your behalf the access ticket for Area C of the Municipality of Milan for the vehicle and date you indicate (the “Area C Service”). By making the request you grant Parkito the necessary mandate.

11.2 Price

Before payment, the municipal charge and Parkito’s service fee are shown separately:

  • ordinary entry: municipal charge € 7.50 + Parkito fee € 2.50 = € 10.00;
  • deferred payment: municipal charge € 22.50 + Parkito fee € 2.50 = € 25.00.

The amounts may vary according to the municipal charges in force; the amount shown before payment is authoritative. The time limits for the request are shown on the service page and are those set by the Municipality of Milan.

11.3 Data and responsibility

You are responsible for the accuracy of the data provided (number plate, date of access, contact details) and for checking that the vehicle is permitted to enter Area C under the rules in force. For official information, consult the Municipality of Milan portal: https://www.comune.milano.it/argomenti/mobilita/area-c. Parkito sends you confirmation of activation. Penalties resulting from incorrect data provided by you, from the vehicle not being permitted or from access on a different date remain your responsibility. Parkito is liable for errors made in activation with respect to the data you provided.

11.4 No refunds

The Area C Service is non-refundable once payment has been made, unless Parkito has not activated the ticket or has activated it in a manner inconsistent with the data you provided. In such cases, what you paid is refunded and any penalty resulting from Parkito’s error is borne by Parkito. Since the service is performed at your request for a specific date, the right of withdrawal is excluded under Art. 59(1)(a) and (n) of the Consumer Code.

General provisions

12. Content

Certain sections of the Parkito Platform allow you to provide text, photographs, videos, information and other content (the “Content”). You are solely responsible for the Content you provide and you warrant that you hold the rights to it.

By providing Content you grant Parkito a non-exclusive, royalty-free, worldwide licence, sublicensable to Parkito’s suppliers, to use, reproduce, adapt and publish it for the purpose of providing and promoting the Parkito Platform, including on social networks and on the third-party services referred to in Art. 5.6. The licence lasts for as long as the Content remains published on the Platform and for a subsequent period not exceeding 12 months for promotional materials already distributed. For photographs and data identifying a private property, the licence is limited to promoting the relevant Listing.

Content must comply with the law and must not be obscene, harassing, defamatory, misleading, violent or discriminatory, or infringe the rights of third parties. Parkito may translate Content automatically and does not guarantee the accuracy of translations.

13. Payments and stored payment method

13.1 Payments

Payments are made in euro, by payment card, through Parkito’s payment service provider. The amount is charged at the time of confirmation. If the Booking cannot be completed, the amount is automatically refunded in full. Refunds are made to the same payment method; crediting times depend on the card issuer.

13.2 Storage of the payment method and subsequent charges

At the time of payment, your payment method is stored securely with the payment service provider. You authorise Parkito to charge it subsequently, without your being present, solely for the following amounts:

  • extensions requested by you or, at your request, by the Support Service (Art. 2.6);
  • amounts for overstaying (Art. 1.4) and for repeated Bookings (Art. 2.7), on the conditions set out therein;
  • amounts due following a Damage Claim, within the limits of Art. 20.2, including the costs of replacing lost keys or devices;
  • for Hosts, the outstanding instalments for Devices (Art. 9.4).

Each charge is notified to you by e-mail at the time it is made, stating the amount, the reason and the calculation. A single charge may not exceed € 500.00, unless you give your express consent. You can view the charges made on the Platform and dispute them with the Support Service within 14 (fourteen) days. You may remove the stored payment method at any time, without prejudice to the obligation to pay sums due.

13.3 Tax documents

For each payment you receive the confirmation and the Booking summary. The payment service provider’s receipt is available on request from the Support Service.

14. Parkito Platform rules

14.1 Rules

You must comply with the following rules and must not help or induce others to breach or circumvent them.

Act with integrity and treat others with respect:

  • do not lie, misrepresent facts or persons, or pretend to be someone else;
  • communicate with others politely and respectfully;
  • do not create duplicate accounts or Listings to circumvent these Terms.

Do not harm the Parkito Platform:

  • do not use bots, crawlers, scrapers or other automated tools to access the Platform or collect its data;
  • do not circumvent security measures and do not decompile the Platform’s software or hardware;
  • do not take any action that impairs its operation.

Use the Platform only within the permitted limits:

  • use other Members’ personal data only to perform a Booking;
  • do not send unsolicited commercial messages;
  • do not conclude or propose Bookings or payments outside the Platform (Art. 14.3);
  • do not manipulate search results or reviews;
  • do not book Parking Spaces you do not intend to use;
  • do not use Parkito’s name, trade marks or content without authorisation.

Comply with the law, including the law on personal data protection, and do not offer Parking Spaces in breach of laws or agreements that concern you.

14.2 Messages between Members

The Platform provides a messaging service between Drivers and Hosts for the purposes of the Booking only. The conversation is available for the duration of the Booking and then remains viewable in read-only mode. Where needed for access to the Parking Space, the Platform allows Drivers and Hosts to call each other starting from 1 (one) hour before the start of the Booking. It is therefore not necessary to exchange contact details.

To prevent circumvention of the Platform, messages containing telephone numbers, e-mail addresses or external links may be blocked or obscured, including by automated tools. Parkito may access messages to handle reports, complaints and disputes, to verify compliance with Art. 14.3, to prevent fraud and to fulfil legal obligations. You may report inappropriate messages or behaviour in accordance with Art. 15. The methods and periods of retention of messages are set out in the Privacy Policy.

14.3 Prohibition on circumventing the Platform

Drivers and Hosts may not use messaging, calls or other Platform tools to:

  • communicate or request telephone numbers, e-mail addresses, social media profiles or other contact details, in order to continue the relationship outside the Platform;
  • propose, request or accept payments outside the Platform, for example in cash, by bank transfer or by payment app, including for future Bookings, extensions or overstays;
  • propose booking the same Parking Space or other Parking Spaces directly, without going through the Platform.

On the first breach, Parkito sends you a written warning. From the second breach onwards, Parkito may, having assessed the seriousness of the case, adopt the measures under Art. 18.3, up to suspension or permanent blocking of the account. Termination with immediate effect (Art. 18.2) and urgent measures in the event of fraud or of a risk to the safety of persons or property remain unaffected.

Agreements and payments concluded outside the Platform are not Bookings within the meaning of these Terms. Parkito is not liable for them and the protections provided by these Terms do not apply to them, including refunds, the Support Service and Damage Claims (Art. 20).

15. Reports, moderation and complaints

15.1 Reporting illegal content

Anyone may report to Parkito Listings, Content, messages or behaviour considered illegal or contrary to these Terms, by writing to help@parkito.app, stating the reasons, the location of the content and their own contact details. Parkito acknowledges receipt of the report, examines it in a timely, diligent and objective manner and communicates its decision with the reasons for it, pursuant to Art. 16 of Regulation (EU) 2022/2065 (the Digital Services Act, “DSA”). In the event of an imminent risk to persons or property, contact the competent authorities first.

15.2 Moderation

Parkito has no general obligation to monitor Content. It may, however, carry out checks on its own initiative and remove or restrict Content that is illegal or incompatible with these Terms. When it adopts a restrictive measure against you, Parkito informs you of the reasons, the facts on which it is based, any use of automated tools and the available means of redress, unless the law precludes this.

15.3 Complaints

You may lodge a complaint against Parkito’s decisions concerning Content, Listings or your account within 6 (six) months, by writing to help@parkito.app. The complaint is examined by qualified staff and not solely by automated tools. Parkito communicates its reasoned decision without undue delay. The means referred to in Art. 28 remain unaffected.

15.4 Cooperation

You agree to cooperate in good faith with Parkito and to provide the information reasonably requested in checks relating to Content or to the use of the Platform.

16. Reviews

At the end of a Booking, the Driver may give a score to the Host, the Parking Space and the overall experience. Only one rating per Booking is permitted. Once submitted, the rating cannot be changed. Only aggregate scores, calculated on the Drivers’ ratings, are published on the Platform. Parkito does not alter ratings and does not select them for publication on the basis of the score.

Parkito may remove ratings that are illegal or manifestly contrary to these Terms. The Host may request a review of a rating in accordance with Art. 15.3.

Parkito may also invite you to leave a review on third-party platforms. The invitation is addressed to all Drivers, regardless of the score given.

17. Automated assistants and artificial intelligence

Parkito uses artificial intelligence systems in certain functions of the Platform, including:

  • the voice assistant that answers the Support Service number;
  • the assistant that responds to WhatsApp messages.

Pursuant to Art. 50 of Regulation (EU) 2024/1689 (the Artificial Intelligence Act), at the start of the interaction you are informed that you are communicating with an automated system, and generated content is labelled as such. You may at any time ask to speak to a human operator.

The voice assistant can provide you with information about your Bookings and point you to available Parking Spaces, with their price and the link to book. It does not conclude Bookings, collect payment data or make cancellations. The information provided by the automated assistants is indicative. The information shown on the Platform at the time of booking is authoritative. The processing of data relating to conversations is described in the Privacy Policy.

18. Termination, suspension and other measures

18.1 Term

The agreement between you and Parkito remains in force until it is terminated by you or by Parkito.

18.2 Termination

You may terminate the agreement at any time by deleting your account, without prejudice to the provisions of Art. 6.3 for Hosts. Parkito may terminate it on 30 days’ notice by e-mail. Parkito may terminate it with immediate effect if:

  • (i) you materially breach these Terms;
  • (ii) you breach applicable law;
  • (iii) this is necessary to protect the personal safety or property of Parkito, Members or third parties, for example in the event of fraud;
  • (iv) your account has been inactive for more than 2 years.

If you are a consumer, in case (i) Parkito first sends you a formal notice to perform with a deadline of not less than 15 days. Exceptions are cases where the breach makes it impossible to continue the relationship or where there are safety requirements or a need to protect third parties.

For Hosts acting as professionals, termination with notice is communicated with a statement of reasons and at least 30 days in advance, pursuant to Art. 4 of Regulation (EU) 2019/1150.

18.3 Measures in the event of breaches

Parkito may adopt the following measures if:

  • you materially breach these Terms or the law;
  • you provide illegal Content;
  • you receive well-founded complaints about your conduct;
  • you repeatedly cancel Bookings without justified reason;
  • you repeatedly fail to guarantee access to Daily Parking Spaces (Art. 5.2.1);
  • you breach the prohibition on circumventing the Platform, on the conditions of Art. 14.3;
  • this is necessary for the safety of persons or property.

The measures are:

  • suspending or restricting use of the Platform or of your account, including messaging;
  • permanently blocking the account;
  • suspending, removing or restricting the visibility of Listings or Content;
  • deactivating the daily mode of a Listing;
  • cancelling pending or confirmed Bookings, with the consequences set out in Arts. 2.3 and 2.4.

Except in cases of urgency or where prohibited by law, Parkito informs you of the measure and the reasons for it before or at the same time as it is adopted (Art. 15.2).

18.4 Orders of authorities

Parkito may take the action reasonably necessary to comply with the law or with orders of judicial or administrative authorities, including the measures under Art. 18.3.

18.5 Effects of termination

If you close your account as a Host, confirmed Bookings on your Parking Spaces are cancelled and the Drivers are refunded in full. If you close your account as a Driver, your confirmed Bookings are cancelled and the refund is determined in accordance with Art. 2.1. The rights of withdrawal under Art. 30 remain unaffected. If the account has been suspended or the agreement terminated by Parkito because of a breach on your part, you may not create a new account or use another Member’s account.

19. Changes to these Terms

19.1 Publication

Parkito may change these Terms for legal, regulatory or security reasons or because of the evolution of its services. Each new version is published on the Parkito Platform with its effective date and a summary of the changes, and can be consulted, together with previous versions, on the “Change history” page.

19.2 Acceptance in the application

From publication, when you open the application you are asked to read the new version and to accept it expressly. Until you accept it, and for no more than 30 (thirty) days from publication, your account remains active in read-only mode. During that period you may view and use Bookings already confirmed, access Parking Spaces and communicate with Support and with other Members. During that period you cannot cancel Bookings. You may not, however, make new Bookings or extensions, or create or modify Listings, prices, availability or payment data.

After 30 (thirty) days from publication, continued use of the Parkito Platform constitutes acceptance of the new version. If you do not wish to accept, you may, at any time within that period, delete your account without any penalty. Bookings already confirmed remain governed by the version in force at the time of their confirmation.

19.3 Guest Driver

Anyone who books without an account accepts the version of the Terms in force at the time of payment.

19.4 Notification of changes

Every change to these Terms is also notified by e-mail to all Members, regardless of the preferences expressed for promotional communications, with a summary of the changes and the effective date. The summary specifically highlights material changes. Material changes include, by way of example:

  • (i) any increase in the Parkito service fees or other fees payable to Parkito, as well as the introduction of new costs;
  • (ii) the removal or significant reduction of essential functionality;
  • (iii) a worsening of the cancellation or refund conditions;
  • (iv) a change in the governing law or the competent court;
  • (v) a change in warranties or limitations of liability;
  • (vi) a change in the criteria for calculating Hosts’ fees, including the price reductions under Art. 5.2.2.

If you are a Host acting as a professional, the changes apply to you only after at least 15 (fifteen) days have elapsed from the notification, or the longer period stated in the notification where the changes require significant technical or commercial adjustments to your Listings, pursuant to Art. 3 of Regulation (EU) 2019/1150. The account restrictions provided for in Art. 19.2 do not apply to you: during the notice period you continue to operate under the conditions of the previous version and, when it expires, the new version applies, unless you have withdrawn. You may withdraw from the agreement before the notice period expires; the withdrawal takes effect within 15 (fifteen) days of the notification.

You may waive the notice period by a written declaration or by a clear affirmative action, such as express acceptance of the new version. Publishing new Listings during the notice period also constitutes a waiver, unless the notice period exceeds 15 (fifteen) days for the reasons stated in the previous paragraph. The notice period does not apply where Parkito must change these Terms to comply with a legal or regulatory obligation that does not allow it to be observed, or, exceptionally, to address an unforeseen and imminent danger, such as fraud, malware, spam, data breaches or other risks to the cybersecurity of the Platform, Drivers or Hosts.

19.5 Clauses requiring specific approval

If the change concerns a clause indicated in the list at the end of these Terms, the express approval referred to in Art. 19.2 also constitutes specific approval pursuant to Arts. 1341 and 1342 of the Italian Civil Code.

20. Claims for damages between Members

20.1 Damage Claim

If a Member considers that you, or someone with you, have culpably damaged property belonging to them or for which they are responsible, or have caused them extraordinary cleaning costs or the loss of Bookings resulting from such damage, they may claim compensation by writing to help@parkito.app (a “Damage Claim”). You are notified of the Damage Claim and may respond. If you agree to pay, you authorise Parkito to collect the amount.

20.2 Investigation by Parkito

If the Members do not reach an agreement, Parkito may examine the Damage Claim. It asks the claimant for the necessary evidence (for example documents, photographs, invoices or expert reports) and allows the other Member to reply and produce counter-evidence. If, on the basis of the evidence and of the statutory rules on the burden of proof, Parkito considers the Damage Claim well-founded, it may pay the amount to the claimant and collect it from the Member responsible. It may charge it to the stored payment method up to a maximum of € 500.00 for each Damage Claim, with notice (Art. 13.2). You may dispute Parkito’s decision by writing to help@parkito.app. For Damage Claims exceeding € 500.00, the Members must use the ordinary legal remedies. In this case Parkito will not make any charge to the Member concerned and the entire amount will be the subject of the ordinary proceedings provided for by law.

Parkito’s decisions on Damage Claims are without prejudice to your rights and to your right to bring legal proceedings.

21. Parkito’s role

For Parking Spaces, Parkito provides the Platform and is not a party to the agreement between the Driver and the Host. It receives Drivers’ payments on behalf of Hosts, through Stripe (Arts. 4.4 and 6.1) and, in the cases under Arts. 2.3 and 2.4, handles cancellation, relocation and refund on behalf of the parties. For the Parkito Services, Parkito is a party to the contract with the Driver on the terms of Arts. 9, 10 and 11.

Parkito does not control the conduct of Members and does not guarantee the truthfulness of the Content they provide. It may examine, remove or restrict Content and Listings in order to manage and protect the Platform, enforce these Terms, fulfil legal obligations and maintain quality standards, with the safeguards of Art. 15.2.

22. Member accounts

22.1 Registration

Many features require an account. Registration is open to natural persons of legal age and to legal entities. You must provide accurate information and keep it up to date, safeguard your credentials and inform Parkito immediately of any unauthorised use of them. You may not transfer your account. You are liable for activities carried out with your account, unless they took place without your authorisation and without negligence on your part.

22.2 Identity verification

For certain features, including publishing Listings and receiving payouts, Parkito asks you to verify your identity through Veriff OÜ (“Veriff”), a specialist provider acting as processor on Parkito’s behalf. Veriff captures an image of your identity document and of your face and compares them to establish that the document belongs to you. Since the comparison involves the processing of biometric data, verification takes place only with your explicit consent, requested before it begins. The processing, including the retention periods for the images, is described in the Privacy Policy. After verification, the first name and surname in the profile correspond to those on the document and cannot be changed from the application. To correct them, contact the Support Service.

22.3 Application updates

For security and compatibility reasons, Parkito may require the application to be updated to a minimum version. In that case, until you update, some functions may not be available. You may nevertheless cancel a Booking through the Support Service, on the conditions of Art. 2.1 calculated as at the date of your request.

23. Disclaimer

Parkito does not guarantee the existence, conduct, safety or suitability of Members or Listings. Identity verification does not ensure the absence of improper behaviour. The label “verified” indicates only that the relevant procedure has been completed. Parkito is not liable for interruptions of the internet or of telecommunications networks beyond its control. It may temporarily restrict the availability of the Platform, with notice where possible, for reasons of capacity, security or maintenance.

24. Discount codes and promotions

24.1 Definition

“Discount Code” means any promotional code, coupon or initiative that reduces the price of a Booking made through the application.

24.2 Conditions

Discount Codes may be used on the conditions communicated from time to time, including any limits on validity, maximum amount and eligible recipients. The discount applies to the price of the stay and to the service fees; it does not apply to ZTL charges. Unless otherwise indicated, Discount Codes:

  • cannot be combined;
  • cannot be converted into cash;
  • are not transferable;
  • can be used only once;
  • do not apply to Guest Driver Bookings.

Codes assigned personally, for example with the monthly summary, may be used only by the recipient account. Discount Codes may be created only by Parkito. The price difference is borne entirely by Parkito itself.

24.3 Revocation and misuse

Parkito may suspend or revoke a Discount Code for justified reasons, without prejudice to Bookings already confirmed. In the event of misuse, for example creating multiple accounts or using codes intended for others, Parkito may cancel the benefit obtained, suspend the account or cancel the Booking concerned. A full refund of the amount actually paid for the cancelled Booking remains guaranteed.

24.4 Summaries and leaderboards

The periodic summaries, statistics and leaderboards shown on the Platform are for information purposes. The amounts shown are estimates and do not constitute a statement of account. Any prizes are governed by the relevant rules.

25. Parkito’s liability

25.1 Parkito is liable without limitation for damage to life, physical integrity or health. It is also liable without limitation for damage caused by its own wilful misconduct or gross negligence or that of its auxiliaries, as well as in cases where the law does not permit limitations.

25.2 Outside the cases under Art. 25.1, for slight negligence Parkito is liable only for breach of essential contractual obligations. Essential obligations are those on whose performance the Member reasonably relies for the performance of the agreement. In such cases liability is limited to direct and foreseeable damage, and in any event to an amount equal to the Total Price of the Booking or the price of the Parkito Service in dispute.

25.3 The limitations in this article do not apply in cases where the law, including consumer protection rules, prohibits the exclusion or limitation of liability. They do not extend to the personal liability of representatives or auxiliaries for wilful misconduct or gross negligence.

26. Indemnification

To the extent permitted by law, if you are not a consumer you agree to indemnify Parkito against third-party claims, damages and expenses, including reasonable legal fees, arising from:

  • (i) your breach of these Terms;
  • (ii) your improper use of the Platform;
  • (iii) your interaction with other Members or the use of a Parking Space;
  • (iv) your failure to fulfil your tax obligations;
  • (v) your breach of the law or of the rights of third parties.

The obligation exists only if there is a causal link with a culpable failure to perform on your part. As regards consumers, the protections of the Consumer Code remain unaffected.

27. Contracting parties

All Indabox S.r.l., with registered office in Bologna (BO), via G. Mazzini n. 11, registered in the Bologna Companies Register, REA no. BO-568791, paid-up share capital € 12,323.26, VAT number and Tax Code 04099131205, PEC autoindabox@pec.it, telephone +39 800 816 980, e-mail help@parkito.app.

28. Governing law, jurisdiction and alternative dispute resolution

28.1 Governing law

These Terms are governed by Italian law. If you are a consumer, the mandatory consumer protection rules of your country of residence remain applicable, if more favourable.

28.2 Jurisdiction

If you are a consumer resident in Italy, the court of the place of your residence or domicile has jurisdiction, pursuant to Art. 66-bis of the Consumer Code. If you are a consumer resident in another Member State of the European Union, you may bring proceedings against Parkito before the court of the place of your domicile or before the court of Bologna, where Parkito has its registered office; Parkito may bring proceedings against you only before the courts of the Member State in which you are domiciled, pursuant to Arts. 17, 18 and 19 of Regulation (EU) No 1215/2012. If you are not a consumer, the Court of Bologna has exclusive jurisdiction. For commercial disputes with a value not exceeding € 50,000.00, the parties that are not consumers undertake first to attempt mediation pursuant to Legislative Decree 28/2010.

28.3 Alternative dispute resolution

You may lodge a complaint with the Support Service (Art. 15.3). If you are a consumer, you may also refer the matter to an alternative dispute resolution (ADR) body entered in the lists referred to in Art. 141-decies of the Consumer Code. For moderation decisions you may refer the matter to bodies certified under Art. 21 of the DSA. Professional Hosts may have recourse to mediation pursuant to Legislative Decree 28/2010. The right to bring legal proceedings remains unaffected.

29. Miscellaneous

29.1 Interpretation. These Terms, supplemented by the conditions shown on the Platform at the time of booking or purchase, constitute the entire agreement between you and Parkito. They do not confer rights on third parties. The invalidity of any clause does not affect the others.

29.2 No waiver. Parkito’s failure to enforce a right does not constitute a waiver, unless the waiver is in writing.

29.3 Assignment. You may not assign the agreement without Parkito’s written consent. Parkito may assign it on 30 days’ notice. If you are a consumer, the assignment requires your consent, which may also be expressed by continuing to use the Platform after the notice period, and you are entitled to terminate the agreement without penalty within the same period.

29.4 Communications. Communications to Members are made electronically, by e-mail, notifications or in-app messages. Communications relating to Bookings, payments, security and changes to these Terms are sent regardless of the preferences for promotional communications. You may unsubscribe from the latter at any time.

29.5 Third-party services. The Platform may contain links to third-party services, the use of which is governed by their respective terms. The providers that process personal data on Parkito’s behalf are listed in the Privacy Policy.

29.6 Google and Apple. Some functions use Google Maps services, which are subject to the related additional terms of service. If you download the application from Apple’s App Store, you also accept the related End User Licence Agreement.

29.7 Confidentiality. Parkito and the Members treat as confidential the non-public information exchanged through the Platform, save as provided by these Terms or by law.

29.8 Intellectual property. The software, interface, trade marks, logos and editorial content of the Platform belong to All Indabox S.r.l. or its licensors. Parkito grants you a limited, revocable, non-exclusive and non-transferable licence to use the application on your device and to consult the Platform for personal use.

29.9 Force majeure. Parkito is not liable for delays or failures to perform due to circumstances beyond its reasonable control whose consequences could not have been avoided. Examples include natural disasters, wars, acts of authorities, pandemics, strikes and interruptions of essential services. The refunds due under Arts. 2.2 and 2.4 remain unaffected.

29.10 Contact. For questions about these Terms you may write to help@parkito.app or to the PEC (certified e-mail) address autoindabox@pec.it, or call +39 800 816 980.

29.11 Conclusion of contracts online. The following information is provided pursuant to Art. 12 of Legislative Decree 70/2003 and applies to Bookings, to the purchase of Parkito Services and to account registration.

Technical steps. To conclude a Booking: (i) you select the Parking Space, the parking period and the vehicle (Art. 1.1); (ii) you check the summary, which states the Total Price, the conditions of the Listing, the Host’s status (Art. 1.2) and any custody (Art. 1.2.1); (iii) you accept these Terms and specifically approve the clauses listed at the end; (iv) you enter your payment details and confirm the order with the payment button. The Booking is concluded in accordance with Art. 1.2. The purchase of Parkito Services follows the same steps, starting from the service page or the Device product sheet. Account registration is concluded by accepting these Terms at the end of the relevant procedure.

Correction of errors. Before confirming the order you can check all the data entered in the summary and correct them by returning to the previous screens or by editing the relevant fields. After confirmation you may change the Booking within the limits of Art. 2.6 or cancel it in accordance with Art. 2.1.

Confirmation and storage. After the order, Parkito sends you without delay, by e-mail, a confirmation with a summary of the contract concluded. Parkito stores the contract in electronic form for the period required by law. You can view your Bookings and purchases on the Parkito Platform, in particular in the “Booking Details” section of the application; if you are a Guest Driver, via the confirmation e-mail. You may also request a copy from the Support Service. These Terms are always available on the Parkito Platform in a form that allows them to be stored and reproduced; previous versions can be consulted in accordance with Art. 19.1.

Language. Contracts are concluded in Italian. This translation is provided for information only; in the event of any discrepancy, the Italian version prevails.

Codes of conduct. Parkito does not subscribe to any codes of conduct.

Complaints and disputes. The complaint and dispute resolution mechanisms are set out in Arts. 15.3 and 28.

30. Right of withdrawal

30.1 Withdrawal from the agreement with Parkito. You may withdraw from the agreement with Parkito at any time, free of charge, by deleting your account (Art. 18.2), without prejudice to future Bookings already confirmed on your Parking Spaces, to which Arts. 6.3 and 18.5 apply.

30.2 Bookings of Parking Spaces and Parkito Services. Bookings of Parking Spaces and the Shuttle Service concern services related to leisure activities or parking to be provided on a specific date or within a specific period. The 14-day right of withdrawal is excluded pursuant to Art. 59(1)(n) of the Consumer Code; the cancellation conditions of Arts. 2.1 and 10.4 remain unaffected. For the Area C Service, Art. 11.4 applies. For the purchase of Devices, Art. 9.3 applies.

30.3 Information. To exercise the right of withdrawal or to receive assistance, you may contact the Support Service.
